CASE RESULTS DEPEND UPON A VARIETY OF FACTORS UNIQUE TO EACH CASE, AND ANY CASE RESULTS REFLECTED ON THE SITE DO NOT GUARANTEE, WARRANTY, OR PREDICT A SIMILAR RESULT IN ANY FUTURE CASE.
You should personally consult with an attorney (e.g. via telephonic or in-person interaction) as to your individual circumstances. You agree that the information and illustrations provided on the Site (including entries in the BaryLaw blog) are neither intended to provide individual legal advice to you in any way, shape or form, nor to create an attorney-client relationship with you.
Be advised that because all of the security in the world on our end will not protect you if you do not follow basic precautions, the transmission of confidential information through the Site is at your own risk, and BaryLaw assumes no liability or responsibility of any nature whatsoever for the security of confidential data so transmitted.
Submission of your personal data, including without limitation your name, email, phone number, or other sensitive data (collectively, "your Data") through this Site provides your consent to our processing of your Data as indicated and in accordance with these Terms and Conditions. This consent explicitly includes the stated purposes indicated on the Site, such as for scheduling an appointment or requesting that we contact you. Your submission further indicates consent to the submission, processing, receipt, and transmission of your Data. Beyond the purposes stated on the Site, you specifically consent to our review and response to your submission, consent to be added to our database for conflicts of interest and other internal business purposes, and consent for the firm to use the information supplied to make contact with you via email or phone for important communications or announcements from the firm. We do not have a mailing list or newsletter, and will require you to opt-in before sending you unsolicited mail that is not directly connected with your request or actual, contemplated, or proposed work for you. We will never sell your contact information or give it out to anyone. You may withdraw your consent at any time by email to firstname.lastname@example.org. If you withdraw your consent, the firm will retain only as much of your information as is necessary for protecting the firm from liability, such as tracking conflicts of interest, for any dispute that may later arise between you and us, and otherwise fulfilling our other ethical duties as required by the Rules of Professional Conduct and other applicable laws, rules, regulations, and binding authority.
If BaryLaw already represents a party whose interests are adverse to your interests (and therefore has a conflict of interest that would preclude our representation of your interests), any information you have submitted via this website may be used by BaryLaw in furtherance of the representation of our existing client(s).
Use of the Site, regardless of whether you receive or submit information or the nature of the information so received or submitted, does not create an attorney-client relationship with Bary W. Hausrath or BaryLaw. An attorney-client relationship will only be created after an initial in-person, email, or telephonic consultation with a duly appointed representative of BaryLaw, and an appropriate conflict of interest check, and then only by: 1) the specific consent of the duly authorized representative of BaryLaw evidenced by a handwritten signature manually or a signature electronically affixed to a written retainer agreement or engagement letter similarly signed by you, and 2) payment of any required initial deposit or retainer and your fulfillment of any other conditions stated in the retainer agreement or engagement letter.
You understand and agree that if you use a coupon code that was not provided to you by BaryLaw staff, we may demand payment of the full amount due under the terms of our engagement letter, or the equivalent amount due at our prevailing hourly rates on theories of implied contract or unjust enrichment, without any credits or downward adjustments.
Directions and traffic information provided on this website is provided by third parties. As BaryLaw has absolutely no input in the production of this information beyond supplying the GPS data for our office location(s), BaryLaw assumes no liability or responsibility of any kind or nature whatsoever for your use or reliance on the data so provided by third parties, and the data is provided without guaranty or warranty, whether express or implied, and of any nature whatsoever, including fitness for any particular purpose.
You and we intend to make these Terms and Conditions, as the expression of the parties’ intentions, enforceable to the maximum extent permitted at law, and accordingly the provisions of these Terms and Conditions are severable. If any clause, provision, term, condition, or paragraph of these Terms and Conditions is invalidated or deemed unenforceable by any court or tribunal of competent jurisdiction, the remaining clauses, provisions, and paragraphs of this Agreement shall remain in full force and effect.
You consent to the exclusive jurisdiction of the courts situated in the City of Richmond, Virginia for any action arising out of a breach of these terms and conditions or for any action arising out of your use of the Site, and you agree that they are an appropriate and proper venue. The laws of the Commonwealth of Virginia shall apply to any such dispute. You further waive the right to a trial by jury. As a condition precedent to litigation, you agree that any dispute not arising out of a written fee agreement must be first submitted to mediation or binding arbitration.
